Greensville County VA Traffic Lawyers

The Code of Virginia classifies various offenses such as reckless driving, aggressive driving, driving on a suspended or revoked license, or habitual offender, to name a few, as serious misdemeanor criminal offenses and require skilled representation. In fact, a motorist can be convicted of Reckless Driving for speeding as little as 11 miles per hour over the limit if the speed allegation is 81 miles per hour in a 70 mile per hour speed zone. A conviction for any traffic misdemeanor can severely jeopardize your freedom, your career, and your driving record.

If you have been arrested or charged with one of these allegations or any other criminal or traffic offense, then you need an accomplished Greensville VA Traffic Lawyer. Many of these criminal traffic offenses are punishable as follows:

  • Maximum fine of $2,500
  • 12 months in jail
  • Suspension or Revocation of driving privileges of up to 6 months or more
  • Assessment of DMV demerit points
  • Increased automobile insurance premiums

Greensville Reckless Driving Speeding 99/70 REDUCED

Riley & Wells traffic attorneys represented a client from Georgia who was traveling on Interstate 95 in Greensville County. She was pulled over for speeding by a Greensville Deputy Sheriff who alleged she was in violation of the Virginia misdemeanor reckless driving law under Va. Code 46.2-862 based on his R.A.D.A.R. evidence of 99 miles per hour in a 70 mph zone. In Virginia, Judges frequently sentence people to jail for driving at such speeds. However, we made various arguments to the Court and were eventually able to convince the Judge to reduce the misdemeanor criminal reckless driving allegation to the minor infraction of speeding 80 miles per hour in a 70 miler per hour zone.

DUI Restricted License Violation 18.2-272 REDUCED No Jail

Riley & Wells traffic lawyers represented a client who was alleged to have been driving in violation of a DUI related restricted driver’s license pursuant to Va. Code 18.2-272. The courts and the DMV take allegations like this very seriously. A conviction will typically lead to a jail sentence and loss of driving privileges for 12 months. In this case, Riley & Wells attorneys were able to find a weakness in the prosecution’s case and were also able to present favorable mitigating evidence on behalf of the client to convince the Judge to significantly reduce the allegation without a jail sentence, without loss of driving privileges and with only a minor fine being imposed. The client was relieved to avoid a jail sentence, to avoid any further loss of driving privileges, and to have the allegation drastically reduced.

Greensville Reckless Driving 97 mph on I95 REDUCED

Riley & Wells traffic attorneys represented a client from Vienna VA for reckless driving speeding 97 mph on Interstate 95 in Greensville VA. Our client was a 59 year old DC professional driving a shiny brand new Ford Mustang around daybreak on his way to a long overdue vacation to Florida. At about the worst time possible, our client decided to “open up” the Mustang and “punched it” for a few seconds. Unfortunately, a Deputy Sheriff was operating stationary RADAR at the exact same location and exact same time as our client and gathered evidence of speeds of 97 miles per hour. At trial, the Deputy Sheriff was present in court and his evidence was sufficient, but Riley & Wells Attorneys had arguments prepared in advance that were going to ideally convince the Judge not to find our client guilty of a misdemeanor criminal offense for a momentary lapse of bad judgment. The Court agreed with our arguments and found our client not guilty of reckless driving and reduced the case to the traffic infraction of speeding only imposing a minor fine.

In addition to the various misdemeanor traffic offenses, there are many other minor traffic ticket offenses that are also moving violations that can trigger various negative consequences. These Greensville VA Traffic Tickets are often only punishable by a fine, court costs and DMV demerit points. In many cases, we can resolve our client’s Virginia Uniform Summons and/or speeding ticket in such a manner that protects both the driving record and the automobile insurance policy. The Greensville VA Traffic Lawyers of Riley & Wells Attorneys-At-Law will work hard to obtain the best possible result for you to protect your driving privileges and limit your risk.
